Use Provisions

Internet Services, Content, Products, and Accuracy of Data:
Digify Dynamics strives to ensure that the information provided on our website is complete, accurate, and up-to-date. We do not guarantee the accuracy or completeness of any information presented on our website.
All features, content, product descriptions, pricing, services, and any statements about our products or services are subject to change at any time without prior notice. Digify Dynamics consistently endeavors to accurately represent all aspects of our offerings to the best of our ability.

Order Confirmations

At Digify Dynamics, it is our standard practice to confirm orders via an email receipt. Receipt of this email binds the client to their obligations as outlined in the Billing and Payments section of this agreement. However, receiving an email receipt does not constitute an agreement beyond the specific details outlined in that receipt.
Clients may request a physical receipt to be mailed; if no physical receipt is received, the emailed copy will serve as the formal receipt. By accessing or “logging in” to our client portal, you confirm that you have received a receipt and agree to be bound by the terms and conditions regarding Billing and Payments below.
We reserve the right, at our sole discretion and without prior notice, to refuse service to any customer or deny access to our website to any visitor or customer who uses it inappropriately or beyond the acceptable scope as determined by Digify Dynamics.

Materials and Content

All materials and content provided by Digify Dynamics or displayed on www.digifydynamics.com require prior written authorization for use or transmission by any user of the website. Any material created by Digify Dynamics and displayed on the website is the sole property of Digify Dynamics. This includes, but is not limited to, product branding, report generation, images, client data, content, and accounts created.

Unauthorized use of these materials or content may violate local, state, or federal laws designed to protect copyrights, trademarks, and intellectual property. It is the client’s responsibility to comply with applicable laws governing their use of the website and to safeguard their personal information, including account usernames and passwords. Additionally, clients are responsible for maintaining the confidentiality of any information displayed on their accounts.
By using the website, you accept responsibility for all activities conducted within your account. Digify Dynamics will not be held liable if your account or its data is compromised by an unauthorized user.

Termination

Digify Dynamics reserves the right to terminate your account at any time and for any reason at our sole discretion. Similarly, you, as the user or account holder, have the right to terminate your account at any time and for any reason, provided it aligns with the guidelines outlined in our Billing and Payments section.

Campaign Ownership

All advertising campaigns created or managed by Digify Dynamics are the exclusive property of Digify Dynamics unless otherwise specified in an additional contract or addendum.

Billing and Payments

Digify Dynamics maintains specific policies regarding billing and payments. These policies apply to all products and services offered by Digify Dynamics, including but not limited to: lead generation PPC, eCommerce PPC, SEO (and related add-ons), websites (and related add-ons), and email campaigns.
Payments may be made by credit card or, in some instances, by check. Please note that any funds spent on your account by Digify Dynamics with third parties (e.g., search engines) are non-refundable. Additionally, set-up fees charged for account creation and establishment are non-refundable.
All accounts are placed on a recurring payment cycle unless otherwise specified by the client at the point of sale. Clients wishing to pause or cancel an account, or opt-out of recurring billing, must notify Digify Dynamics at least 2 business days before the next payment due date. It is the sole responsibility of the client to contact Digify Dynamics to cancel their account.
Credit card payments must be successfully processed to maintain account activity and prevent downtime or temporary service termination. Failure to process payments may result in account suspension.

Stripe Dispute Process: Payment disputes must first be addressed with Digify Dynamics. If unresolved, clients may utilize Stripe’s built-in dispute resolution tools.

Governing Law: All payment-related disputes are governed by the laws of New York, as specified in our general TOS.

Invoice Processing: All invoices are processed via Stripe. By submitting payment, you agree to Stripe’s Services Agreement.

Recurring Billing: Services provided on a subscription basis will automatically renew unless canceled in writing at least 5 business days before the next billing date.

Payment Authorization: By providing your payment information, you authorize Digify Dynamics and Stripe to charge the specified amount for the agreed-upon services.

Limitation of Liability & Client Responsibility

Digify Dynamics accepts no responsibility if an account is brought offline due to technical difficulties at our facilities or those of third-party vendors we rely on. Additionally, due to the technical nature of our products and services, Digify Dynamics cannot be held liable for any unforeseen technical difficulties that may occur. Our advertising and marketing services are designed to be managed and implemented by Digify Dynamics; however, we do not guarantee any specific increase in business, website traffic, or other measurable outcomes from advertisements. Any loss of business resulting from an advertisement is the sole responsibility of the client. Furthermore, if a client identifies an error in their account, advertisement, or any product or service provided by Digify Dynamics, it is the client’s responsibility to contact us promptly to request corrections. Failure to do so may affect outcomes and will not be the liability of Digify Dynamics.

Third-Party Disclosure

Digify Dynamics utilizes third parties for various products and services and cannot be held responsible for any downtime, disruptions, or loss of business resulting from failures or issues related to these third parties.

Representations and Warranties

Each party represents and warrants that it has the legal power and authority to enter into this agreement and fully understands and agrees to all the terms and conditions outlined herein.

Intellectual Property Notice

All elements of this website (www.digifydynamics.com) that have been created by Digify Dynamics are the intellectual property of Digify Dynamics.
